What to know about a suspended Licence

Persons convicted of violations under the Criminal Code of Canada, the Motor Vehicle Accident Claims Act, or the Traffic Safety Act, involving the operation or control of a motor vehicle may be suspended or disqualified from driving in accordance with limits stated in the Traffic Safety Act.

It is unlawful to be in possession of an operator’s Licence while it is suspended or disqualified. It is a serious offence to drive while unauthorized, punishable by law. Drivers stopped by a peace officer and found to have their operator’s Licence suspended will have the vehicle they were driving seized and impounded for a period of 30 days.

If the vehicle seizure involves the same suspended driver and owner within a three-year window, the seizure period is 60 days. Only individuals who are in possession of a full, non-GDL driver’s Licence can apply for a restricted drivers Licence due to a demerit suspension.

Depending on the nature of the suspension, individuals may need to meet specific conditions, provide medical clearance if applicable, and demonstrate a commitment to safe and responsible driving. The reinstatement process aims to ensure that individuals have taken the necessary steps to address the issues that led to their Licence suspension and are prepared to return to the road as responsible drivers.

  • Less than one year – reinstatement requires the payment of the appropriate fee.
  • Over one year but less than three – A basic road test must be taken. When passed, the previous class of Licence will be reinstated.
  • Over three years – All previous driving credits are lost. The driver must start as a new driver.

Eligibility for reinstating your driver’s Licence depends on the reason for the suspension. Generally, you must serve the mandated suspension period, complete any required programs (like defensive driving or alcohol education courses), and settle any outstanding fines or penalties.

The steps to reinstate your Licence vary based on the reason for the suspension. They usually include serving the suspension duration, fulfilling any conditions set by the authorities, attending required programs, and paying applicable fees. Some situations might necessitate medical clearance as well.

In some cases, you might be eligible for a restricted or probationary Licence during your suspension period. This allows you to drive under specific conditions, such as to and from work or medical appointments. However, full reinstatement usually occurs only after completing the required suspension period and fulfilling all conditions. You’ll need to contact the appropriate authorities to learn the steps specific to your case.

Yes, there are typically reinstatement fees associated with regaining your driver’s Licence. These fees help cover administrative costs related to the reinstatement process. The specific amount can vary depending on the reason for the suspension and the type of Licence you hold. It’s advisable to inquire about the exact fee when planning for reinstatement.
